Service Agreement - Dog Walking Group & Solo

This Agreement between The Client (hereinafter known as "The Client") and Toe Beans Co Pty Ltd (ACN 701 290 208, ABN 39 701 290 208) trading as The Toe Beans Co (hereinafter known as “The Toe Beans Co”) pertains to the following: 

The parties herein agree as follows:

1. This contract will take effect upon signature by both Client and The Toe Beans Co and will remain in effect until terminated by either party, with the first service beginning as scheduled. 
2. Client understands they will be charged the rates as described on the website. In this instance, all walking services will be pre-paid. All scheduled walks will be governed by all the terms of this contract. In the event that a walk has NOT BEEN PAID UP TO 24 HOURS BEFORE THE SESSION, THE SESSION WILL BE CANCELLED
3. CANCELLATION POLICY: In the event that the client cancels within 24 HOURS of the session, the session will not be refunded.
4. This user service agreement applies to the following services:
   1. Solo Dog Walking: defined for the remainder of this document as one-to-one walking between a dog walker and their client. Service duration is defined as found in the booking portal along with associated cost
   2. Group Dog Walking: defined for the remainder of this document as many-to-one group walking between pet owners and dog walker. In line with Australian Law, no group walking may exceed 4 dogs per walker. 
5. All clients are required to complete their registration form detailing behavioural information about their dog. The Toe Beans Co reserves the right to refuse any services based on a) information that we deem to make the situation unsafe for other dogs or b) where false information has been given
6. The Toe Beans Co is authorised to perform care and services as outlined on this contract. Both The Toe Beans Co and Client recognise that the welfare of the animal is the highest priority. If in The Toe Beans Co's  judgement additional services become necessary during the service period to properly care for the animal, The Toe Beans Co will first make reasonable attempts to contact the Client. All clients must specify specific instructions during registration, including but not limited to:
   1. Consultation with Client’s Veterinarian listed above, or with an emergency veterinary care provider should Client’s Veterinarian be unavailable
   2. Authorisation and guidance on authorising care and treatment as recommended by Client’s Veterinarian or an emergency veterinary care provider (excluding euthanasia) as outlined in the Veterinary Authorisation Form detailed in your registration profile
   3. Such other steps as may in the reasonable judgment of The Toe Beans Co be necessary or appropriate for the health and welfare of the animal.  
7. Client must provide clear guidance on payment preferences in the event of emergency care . Client agrees to be responsible for all fees and expenses incurred for care and treatment of the animal pursuant to this paragraph, and releases and holds The Toe Beans Co harmless from all liabilities related to transportation, treatment and expense. Client agrees to reimburse The Toe Beans Co  for any expense incurred, plus any additional fees for attending to animal’s needs or any expenses incurred for any other home/food/supplies needed IN FULL.
8. In the event of inclement weather, natural disaster, or circumstances beyond our control, e.g., acts of terrorism, etc., The Toe Beans Co is entrusted to use best judgment in caring for pet(s) and home. The Toe Beans Co will be held harmless for consequences related to such decisions. 
9. The Toe Beans Co agrees to provide the services stated in this contract in a reliable, caring and trustworthy manner. In consideration of these services and as an express condition thereof, CLIENT EXPRESSLY WAIVES AND RELINQUISHES ANY AND ALL CLAIMS AGAINST THE TOE BEANS CO ARISING OUT OF OR RELATING TO THE PROVISION OF SERVICES HEREUNDER, EXCEPT THOSE ARISING FROM GROSS NEGLIGENCE OR WILLFUL MISCONDUCT ON THE PART OF THE TOE BEANS CO SHOULD THE TOE BEANS CO OR ANY AUTHORISED PERSON ACCOMPANYING THE TOE BEANS CO SUSTAIN ANY INJURY, DISEASE OR OTHER HARM IN THE COURSE OF PROVIDING SERVICES HEREUNDER, CLIENT WILL INDEMNIFY THE TOE BEANS CO  AND HOLD IT HARMLESS WITH RESPECT TO ALL LOSS, EXPENSE AND DAMAGE TO THEIR PROPERTY, PERSONS OR PET CAUSED THEREBY, EXCEPT THOSE ARISING FROM GROSS NEGLIGENCE OR WILLFUL MISCONDUCT ON THE PART OF THE TOE BEANS CO 
10. In the event of personal emergency or illness of The Toe Beans Co, Client authorises The Toe Beans Co to arrange for another qualified person to fulfil responsibilities as set forth in this contract. In such case, The Toe Beans Co will remain fully responsible for the proper discharge of all services under this Agreement. Every attempt will be made to notify client regarding such situation. 
11. All dogs are to be currently vaccinated.
12. Declaration of Dog characteristics. In the event that client’s willfully mislead or provide false information with regard to Dog characteristics this contract will be void. Characteristics, in this instances, includes but is not limited to:
    1. Aggressive behaviour towards other dogs
    2. Aggressive behaviours towards humans
    3. Neutering Status
    4. History of Biting
    5. History of Communicable Diseases
    6. Vaccination Status
13. The Toe Beans Co and Client each may terminate this contract at any time within written notice. The Toe Beans Co will be entitled to payment for all services rendered until notice of termination is received, and for any transition services reasonably required to provide for the health and welfare of Client’s dog(s). The Toe Beans Co  will not terminate during a period of scheduled service unless The Toe Beans Co determines, in their sole discretion, that a danger exists to the health or safety of The Toe Beans Co.
14. In the event that the client would like The Toe Beans Co to administer medication, client’s must complete the “medication permissions administration” part of their dog’s profile. In the event that the Toe Bean’s Co feels that it cannot deliver the medical care required, because it is outside of the requirements of a pet sitter, the client must provide explicit instructions on the expectation of The Toe Beans Co  before service may resume.
15. Client acknowledges that by signing below, they are providing written approval for the provision of services by The Toe Beans Co during any service period scheduled by Client and accepted by The Toe Beans Co.
16. Due to a dog’s excitement to see us, “door darting” may be attempted by a dog. We take every precaution to prevent this from occurring, but do require that all dogs under our care wear an I.D. tag (or collar) stating their name and your phone number.

End User Service Agreement - Pet Sitting

This Agreement between The Client (hereinafter known as "The Client") and Toe Beans Co Pty Ltd (ACN 701 290 208, ABN 39 701 290 208) trading as The Toe Beans Co (hereinafter known as “The Toe Beans Co”) pertains to the following:

The parties herein agree as follows:

1. This contract will take effect upon signature by both Client and The Toe Beans Co and will remain in effect until terminated by either party, with the first service beginning as scheduled. Future sessions can be booked through the website using the in built calendar functionality.
2. Client understands they will be charged the rates as described on the website. In this instance, all sitting services will be pre-paid. All scheduled sits will be governed by all the terms of this contract.
3. Clients may pay through the website for all appointments. All payments are required in full before services can be delivered. 
4. CANCELLATION POLICY: In the event that the client cancels within 24 HOURS of the session, the session will not be refunded. 
5. Long Term Cat Sitting: In line with ethical practices, The Toe Beans Co will not accept long term sitting jobs for cats where we do not visit at least once per day.
6. This user service agreement applies to the following services:
   1. In Home Dog Sitting (Day Slot): Session lengths may vary
   2. Overnight Slot Sitting: defined for the remainder of this document as a pet sitter coming to your property for an overnight stay. The sitter will be required to stay in your house overnight. A time slot will be agreed between the owner and the pet sitter. The overall time slot may not exceed more than 10 hours.
7. Before providing any services, the Client must complete their profile to submit information about their pet, their pet's routine and home visit requirements
8. Other Persons on Property: During the visit, the Toe Beans Co will not be able to accept persons other than the owners to enter the house. This includes neighbours, workmen, or relatives with specific prior written consent from the client BEFORE the session takes place. The Toe Beans Co accepts no liability for any damages, both material or immaterial, to the home, pet or external persons caused as a result of other persons in the residence.
9. The Toe Beans Co is authorised to perform care and services as outlined on this contract. Both The Toe Beans Co and Client recognise that the welfare of the animal is the highest priority. If in Toe Beans Co’s judgement additional services become necessary during the service period to properly care for the animal, The Toe Beans Co will first make reasonable attempts to contact the Client. 13. 16. The Toe Beans Co / Pet Sitter and Client each may terminate this contract at any time by written notice to the other. At Home Dog Training

This Agreement between the client and Toe Beans Co Pty Ltd (ACN 701 290 208, ABN 39 701 290 208) trading as The Toe Beans Co (hereinafter known as “The Toe Beans Co”) pertains to the following: 

For good and valuable consideration, the parties agree as follows: 

1. Training Fees: 
   1. Client agrees to pay The Toe Beans Co a fee for the training consultation as defined by the Toe Beans Co. The fee is due in full BEFORE the training session can be completed. The approximate length of a training session is a MAXIMUM of 2 - 2.5 hours.
   2. Sessions are paid in full and up front.
2. Services: Toe Beans Co agrees to provide private sessions for Client and dog on a session by session basis, the goal being to teach Client how to train and work with Dog. These sessions will take place at Client's home and/or park.
   1. Toe Beans Co will make every reasonable effort to help Client achieve training and behaviour modification goals
   2. Toe Beans Co makes NO GUARANTEE OF AN IMMEDIATE IMPROVEMENT OR COMPLETE REMOVAL IN DOG’S PERFORMANCE / BEHAVIOUR ISSUE AS A RESULT OF PROVIDING PROFESSIONAL ANIMAL BEHAVIOR CONSULTATION. Client understands that he/she and members of the household must follow Toe Beans Co’s instructions without modification, work with dog daily as recommended, and constantly reinforce training being given to dog. 
3. Cancellation Policy: If Client fails to give at least 24 hours cancellation notice, or is not present at time of scheduled appointment, the session is non-refundable.
4. Liability: If Dog becomes ill or causes property damage, or bites or injures any dog, animal or person (including but not limited to Toe Beans Co and Toe Beans Co’s agents), during or after the term of this Agreement, then Client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify Toe Beans Co and Toe Beans Co’s agents from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees. If Dog is injured in a fight or in any other manner during or after the term of the Agreement, Client assumes the risk and agrees that Toe Beans Co should not be held responsible for any resulting injuries, losses, damages, costs or expenses.
5. Assumption of the Risk: Client hereby expressly and specifically assumes the risk of injury or harm in the activities and releases Toe Beans Co from all liability for injury, illness, death, or property damage resulting from the Activities. Client understands that Toe Beans Co does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance in the event of injury, illness, or death of dog. 
6. Medical Treatment: Client does hereby release and forever discharge Toe Beans Co from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Client’s Activities with Toe Beans Co. 
7. The Toe Beans Co: Reserves the right to discontinue sessions for any reason whatsoever. At Toe Beans Co's sole election, Toe Beans Co's duties hereunder shall terminate if (a) in Toe Beans Co's sole judgment Dog is dangerous or vicious to Toe Beans Co or any other person or animal, or interferes with the training of other dogs, or (b) Client breaches any term or condition of this Agreement. Upon termination in accordance with the foregoing, Toe Beans Co's duties shall terminate but all other provisions of this Agreement shall continue in full force and effect. 
8. This Agreement is binding upon Client, spouse of Client, and children of Client, or any other persons present during training session. This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties, and expresses the entire agreement between Client and Toe Beans Co regarding the matters described above. 
9. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made with regard to dog or anything else. Without limiting the generality of the foregoing, Client acknowledges that Toe Beans Co has not represented, promised, guaranteed or warranted that dog will never bite, that dog will not be dangerous or vicious in the future, that dog will not exhibit other behavioural problems, or that the results of the training will last for any particular amount of time. This Agreement may be amended only by a written instrument signed by both Client and Trainer. 

Puppy Program (Including Puppy School)

This Agreement between The Client (hereinafter known as "The Client") and Toe Beans Co Pty Ltd (ACN 701 290 208, ABN 39 701 290 208) trading as The Toe Beans Co (hereinafter known as “The Toe Beans Co”) pertains to the following: 

For good and valuable consideration, the parties agree as follows: 

1. Training Fees: 
   1. Client agrees to pay The Toe Beans Co a fee for enrolment in the puppy program. All fee's are due on booking 
2. Services: The Toe Beans Co agrees to provide the following elements for the client as part of the puppy program. Each of these services may or may not be included based on the selections made by the Client
   1. In person home consultation (herein known after as "1:1 Puppy Intro Session")
   2. Puppy School: 4 Weeks of group training with other puppies also enrolled in the program
   3. Enrolment in "The Complete Puppy Program" online program contained within "The Toe Beans Co Skool Community"
   4. Additional 1:1 puppy training sessions as outlined and requested by the client
   5. Puppy daycare sessions: Puppy's will be taken to a daycare facility and given socialisation time with other dogs or puppies (dependent on vaccination and health status)
3.  Toe Beans Co agrees to provide private sessions for Client and dog on a session by session basis, the goal being to teach Client how to train and work with Dog. These sessions will take place at Client's home and/or park.
   1. Toe Beans Co will make every reasonable effort to help Client achieve a confident and calm dog
   2. Toe Beans Co makes NO GUARANTEE OF THAT THE PUPPY WILL GROW UP INTO A CALM DOG THAT HAS ZERO BEHAVIOURAL ISSUES AS A RESULT OF PROVIDING PROFESSIONAL ANIMAL BEHAVIOR CONSULTATION AND ENROLLMENT IN THE COMPLETE PUPPY PROGRAM. Client understands that he/she and members of the household must follow Toe Beans Co’s instructions without modification, work with dog daily as recommended, and constantly reinforce training being given to dog. 
4. Cancellation Policy: Once a client has been given access to the "Complete Puppy Program" all fees are non-refundable.
5. Liability: If your dog becomes ill or causes property damage, or bites or injures any dog, animal or person (including but not limited to other puppy program participants, The Toe Beans Co or Toe Beans Co’s agents), during or after the term of this Agreement, then Client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify Toe Beans Co and Toe Beans Co’s agents from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees. If dog is injured in a fight or in any other manner during or after the term of the Agreement, client assumes the risk and agrees that Toe Beans Co should not be held responsible for any resulting injuries, losses, damages, costs or expenses.
6.
